THYDOC is an online aggregator of data related to health sector (Hospitals, Doctors and Labs). At "THYDOC" the patient can search best Hospitals, Doctors and Labs.

  1. NATURE AND APPLICABILITY OF TERMS Please carefully go through these terms and conditions ("Terms") and the privacy policy available at https://www.thydoc.com/privacy-policy ("Privacy Policy") before you decide to access the Website or avail the services made available on the Website by THYDOC. These Terms and the Privacy Policy together constitute a legal agreement ("Agreement") between you and THYDOC in connection with your visit to the Website and your use of the Services (as defined below).The Agreement applies to a Hospitals, Doctors and Labs and/or similar institution wishing to be listed, or already listed, on the Website, or
    1. A patient, his/her representatives or affiliates, searching for Hospitals, Doctors and Labs through the Website ("User"); or
    2. Otherwise a user of the Website ("you" or "User").
    3. For Hospitals: Listing of Hospitals including its Accreditations, Specialities, Procedures (Cost And Detail), Quality Indicators, Facilities, Hospital Empanelment's And Insurances, Patient Feedback Loop System, Clinical Achievements, Location With Contact Numbers and blogs;
    4. For Doctors: Listing of Doctors including doctors Biodata Highlighting, Professional Education, Academics, Experience, Procedures used by doctor for treatment, Diseases handled by the doctors Along With Feedback Loop System and Blogs
    5. For Labs: Listing of Labs Pathology, Microbiology, Biochemistry and Radio Diagnosis. This will provide the Labs Accreditations, Test Available (Cost And Detail), Health Packages, Facilities, Patient Feedback Loop System, Location With Contact Numbers
    6. For other Users: Facility to
      1. search for Hospitals, Doctors and Labs by name, specialty, and geographical area, or any other criteria that may be developed and made available by THYDOC;
      2. to make bookings with Hospitals, Doctors and Labs;
      3. the user can either book an appointment for himself or on behalf of his family members, relatives or friends;
  2. CONDITIONS OF USEYou must be 18 years of age or older to register, use the Services, or visit or use the Website in any manner. By registering, visiting and using the Website or accepting this Agreement, you represent and warrant to THYDOC that you are 18 years of age or older, and that you have the right, authority and capacity to use the Website and the Services available through the Website, and agree to and abide by this Agreement.
  3. TERMS OF USE APPLICABLE TO ALL USERS OTHER THAN PRACTITIONERS The terms in this Clause 3 are applicable only to Users other than Practitioners.USER ACCOUNT AND DATA PRIVACY
    1. The terms "personal information" and "sensitive personal data or information" are defined under the SPI Rules, and are reproduced in the Privacy Policy.
    2. THYDOC may by its Services, collect information relating to the devices through which you access the Website, and anonymous data of your usage. The collected information will be used only for improving the quality of THYDOC services and to build new services.
    3. The Website allows THYDOC to have access to registered Users' personal email or phone number, for communication purpose so as to provide you a better way of booking appointments and for obtaining feedback in relation to the Hospitals, Doctors and Labs and their practice.
    4. The User is expected to read and understand the Privacy Policy, so as to ensure that he or she has the knowledge of, inter-alia:
      1. the fact that certain information is being collected;
      2. the purpose for which the information is being collected;
      3. the intended recipients of the information;
      4. the nature of collection and retention of the information; and
      5. the name and address of the agency that is collecting the information and the agency that will retain the information; and
      6. the various rights available to such Users in respect of such information.
    5. THYDOC shall not be responsible in any manner for the authenticity of the personal information or sensitive personal data or information supplied by the User to THYDOC or to any other person acting on behalf of THYDOC.
    6. If a User provides any information that is untrue, inaccurate, not current or incomplete (or becomes untrue, inaccurate, not current or incomplete), or THYDOC has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, THYDOC has the right to discontinue the Services to the User at its sole discretion.
    7. THYDOC may use such information collected from the Users from time to time for the purposes of debugging customer support related issues.

RELEVANCE ALGORITHMTHYDOC relevance algorithm for the Hospital, Doctors and Labs is a fully automated system that lists the Hospital, Doctors and Labs, their profile and information regarding their Accreditations, Specialities, Procedures (Cost And Detail), Quality Indicators, Facilities, Hospital Empanelment's And Insurances, Patient Feedback Loop System, Clinical Achievements, Location With Contact Numbers and blogs on its Website. These listings of Hospital, Doctors and Labs do not represent any fixed objective ranking or endorsement by THYDOC. THYDOC will not be liable for any change in the relevance of the Hospital, Doctors and Labs on search results, which may take place from time to time. The listing of Hospital, Doctors and Labs will be based on automated computation of the various factors including inputs made by the Users including their comments and feedback. Such factors may change from time to time, in order to improve the listing algorithm. THYDOC in no event will be held responsible for the accuracy and the relevancy of the listing order of the Hospital, Doctors and Labs on the Website.
  5. DOCTORS SERVICES As a condition of your use of and access to the services provided through the Website and Your acceptance of these Terms of Use, You are subject to the following rules/ guidelines: Terms for use of the Doctor Services: 
    1. THYDOC provides Services through the Website as a marketplace and facilitates the Users to avail services offered by Third Party Doctors through the Website. THYDOC is not and shall not be responsible for any services rendered by the Third Party Doctors and does not deal with any of Third Party Doctors client or patient managed by Third Party Doctors through the Website and only provides facilitation Services to the Users through the Website. Use of the Website may require the Third Party Doctors to use software and the Third Party Doctors have to ensure the procurement of such software from the concerned providers. User and the Third Party Doctors agree to use the Website and the materials provided therein only for purposes that are permitted by: (a) these Terms of Use; and (b) any applicable law(s), regulation or generally accepted practices or guidelines in the relevant jurisdictions.
    2. The Third Party Doctors may not access the Services if the Third Party Doctors are THYDOC direct competitor, except with THYDOC prior written consent. In addition, the Third Party Doctors may not access the Services for purposes of monitoring their availability, performance or functionality, or for any other benchmarking or competitive purposes.
    3. THYDOC will provide to the Third Party Doctors basic support for the Services at no additional charge, and/or upgraded support if purchased separately and will use commercially reasonable efforts to make the Services available 24 (twenty-four) hours a day, 7 (seven) days a week, except for (i) planned downtime or (ii) any unavailability caused by circumstances beyond THYDOC reasonable control, including without limitation Force Majeure Events (as defined herein below). THYDOC will provide the Services only in accordance with applicable law(s) and government regulations.
    4. The Services may be subject to certain limitations, such as, limits on disk storage space, on the number of calls Third Party Doctors are permitted to make against THYDOC application programming interface, and, other limitations dependent on the Third Party Doctors plan, for example, number of SMS, or number of Users. Any such limitations are specified in the Third Party Doctors plans. The Services provide real-time information to enable Third Party Doctors to monitor such Third Party Doctors compliance with such limitations.
    5. Notwithstanding anything to the contrary contained herein, Third Party Doctors alone shall be liable for Third Party Doctors dealings and interaction with the Users who avail the services of the Third Party Doctors contacted or managed through the Website and THYDOC shall have no liability or responsibility in this regard. THYDOC does not guarantee or make any representation with respect to the correctness, completeness or accuracy of the information or details provided by such User, Third Party Doctors or any diagnostic centre or any third party through the Website. The Services should not be used for emergency appointment purposes.
    6. Notwithstanding anything to the contrary contained herein, Third Party Doctors alone shall be liable for dealings and interaction with Users contacted or managed through the Website and THYDOC shall have no liability or responsibility in this regard. THYDOC does not guarantee or make any representation with respect to the correctness, completeness or accuracy of the information generated by the Third Party Doctors.
    7. THYDOC may, at its sole discretion, suspend Third Party Doctors or Users ability to use or access the Website at any time while THYDOC investigates complaints or alleged violations of these Terms of Use, or for any other reason. THYDOC has the right to edit profiles of Third Party Doctors to make them more suitable for package searches on the Website. If Third Party Doctors and/ or Users find any wrong information on the Website in relation to such Third Party Doctors and/ or User, they can contact THYDOC immediately for such corrections. THYDOC shall have no liability or responsibility in this regard.
  6. HOSPITAL SERVICES As a condition of your use of and access to the hospital services provided through the Website and Your acceptance of these Terms of Use, You are subject to the following rules/ guidelines:Terms for use of the Hospital Services:
    1. THYDOC provides Services through the Website as a marketplace and facilitates the Users to avail Hospital facilities offered by Third Party hospital through the Website. THYDOC is not and shall not be responsible for any information collected, diagnosis by the Third Party Hospital and does not deal with any of Third Party Hospital client or patient managed by Third Party Hospital through the Website and only provides facilitation Services to the Users through the Website. Use of the Website may require the Third Party Hospital to use software and the Third Party Hospital have to ensure the procurement of such software from the concerned providers. User and the Third Party Hospital agree to use the Website and the materials provided therein only for purposes that are permitted by: (a) these Terms of Use; and (b) any applicable law(s), regulation or generally accepted practices or guidelines in the relevant jurisdictions.
    2. The Third Party Hospital may not access the Services if the Third Party Hospital is THYDOC direct competitor, except with THYDOC prior written consent. In addition, the Third Party Hospital may not access the Services for purposes of monitoring their availability, performance or functionality, or for any other benchmarking or competitive purposes.
    3. THYDOC will provide to the Third Party Hospital basic support for the Services at no additional charge, and/or upgraded support if purchased separately and will use commercially reasonable efforts to make the Services available 24 (twenty-four) hours a day, 7 (seven) days a week, except for (i) planned downtime or (ii) any unavailability caused by circumstances beyond THYDOC reasonable control, including without limitation Force Majeure Events (as defined herein below). THYDOC will provide the Services only in accordance with applicable law(s) and government regulations.

The Services may be subject to certain limitations, such as, limits on disk storage space, on the number of calls Third Party Hospital are permitted to make against THYDOC application programming interface, and, other limitations dependent on the Third Party Hospital plan, for example, number of SMS, or number of Users. Any such limitations are specified in the Third Party Hospital plans. The Services provide real-time information to enable Third Party Hospital to monitor such Third Party Hospital compliance with such limitations.
    5. Notwithstanding anything to the contrary contained herein, Third Party Hospital alone shall be liable for Third Party Hospital dealings and interaction with the Users who avail the services of the Third Party Hospital contacted or managed through the Website and THYDOC shall have no liability or responsibility in this regard. THYDOC does not guarantee or make any representation with respect to the correctness, completeness or accuracy of the information or details provided by such User, Third Party Hospital through the Website. The Services should not be used for emergency appointment purposes.
    6. THYDOC may, at its sole discretion, suspend Third Party Hospital or Users ability to use or access the Website at any time while THYDOC investigates complaints or alleged violations of these Terms of Use, or for any other reason. THYDOC has the right to edit profiles of Third Party Hospital to make them more suitable for searches on the Website. If Third Party Hospital and/ or Users find any wrong information on the Website in relation to such Third Party Hospital and/ or User, they can contact THYDOC immediately for such corrections. THYDOC shall have no liability or responsibility in this regard.
  7. DIAGNOSTICS SERVICES As a condition of your use of and access to the diagnostic services provided through the Website and Your acceptance of these Terms of Use, You are subject to the following rules/ guidelines:Terms for use of the Diagnostic Services:
    1. THYDOC provides Services through the Website as a marketplace and facilitates the Users to avail diagnostic test/ packages facilities offered by Third Party Labs through the Website. THYDOC is not and shall not be responsible for any sample collected, tests conducted and reports generated by the Third Party Labs and does not deal with any of Third Party Labs' client or patient managed by Third Party Labs through the Website and only provides facilitation Services to the Users through the Website. Use of the Website may require the Third Party Labs to use software and the Third Party Labs have to ensure the procurement of such software from the concerned providers. User and the Third Party Labs agree to use the Website and the materials provided therein only for purposes that are permitted by: (a) these Terms of Use; and (b) any applicable law(s), regulation or generally accepted practices or guidelines in the relevant jurisdictions.
    2. The Third Party Labs may not access the Services if the Third Party Labs are THYDOC direct competitor, except with THYDOC prior written consent. In addition, the Third Party Labs may not access the Services for purposes of monitoring their availability, performance or functionality, or for any other benchmarking or competitive purposes.
    3. THYDOC will provide to the Third Party Labs basic support for the Services at no additional charge, and/or upgraded support if purchased separately and will use commercially reasonable efforts to make the Services available 24 (twenty-four) hours a day, 7 (seven) days a week, except for (i) planned downtime or (ii) any unavailability caused by circumstances beyond THYDOC reasonable control, including without limitation Force Majeure Events (as defined herein below). THYDOC will provide the Services only in accordance with applicable law(s) and government regulations.

The Services may be subject to certain limitations, such as, limits on disk storage space, on the number of calls Third Party Labs are permitted to make against THYDOC application programming interface, and, other limitations dependent on the Third Party Labs plan, for example, number of SMS, or number of Users. Any such limitations are specified in the Third Party Labs' plans. The Services provide real-time information to enable Third Party Labs to monitor such Third Party Labs' compliance with such limitations.
    5. Notwithstanding anything to the contrary contained herein, Third Party Labs alone shall be liable for Third Party Labs' dealings and interaction with the Users who avail the services of the Third Party Labs or diagnostic centres contacted or managed through the Website and THYDOC shall have no liability or responsibility in this regard. THYDOC does not guarantee or make any representation with respect to the correctness, completeness or accuracy of the information or details provided by such User, Third Party Labs or any diagnostic centre or any third party through the Website. The Services should not be used for emergency appointment purposes.
    6. Notwithstanding anything to the contrary contained herein, Third Party Labs alone shall be liable for dealings and interaction with Users contacted or managed through the Website and THYDOC shall have no liability or responsibility in this regard. THYDOC does not guarantee or make any representation with respect to the correctness, completeness or accuracy of the tests conducted and reports generated by the Third Party Labs.
    7. THYDOC may, at its sole discretion, suspend Third Party Labs or Users ability to use or access the Website at any time while THYDOC investigates complaints or alleged violations of these Terms of Use, or for any other reason. THYDOC has the right to edit profiles of Third Party Labs to make them more suitable for package searches on the Website. If Third Party Labs and/ or Users find any wrong information on the Website in relation to such Third Party Labs and/ or User, they can contact THYDOC immediately for such corrections. THYDOC shall have no liability or responsibility in this regard.
  8. LISTING CONTENT AND DISSEMINATING INFORMATION
    1. THYDOC collects, directly or indirectly, and displays on the Website, relevant information regarding the profile and practice of the Hospital, Doctors and Labs listed on the Website, such as their specialization, qualification, fees, location, visiting hours, and similar details. THYDOC takes reasonable efforts to ensure that such information is updated at frequent intervals. Although THYDOC screens and vets the information and photos submitted by the Practitioners, it cannot be held liable for any inaccuracies or incompleteness represented from it, despite such reasonable efforts.
    2. THYDOC does not guarantee the accuracy or completeness of any content or information provided by Users on the Website. To the fullest extent permitted by law, THYDOC disclaims all liability arising out of the User's use or reliance upon the Website, the Services, representations and warranties made by other Users, the content or information provided by the Users on the Website, or any opinion or suggestion given or expressed by THYDOC or any User in relation to any User or services provided by such User.
    3. THYDOC assumes no responsibility, and shall not be liable for, any damages to, or viruses that may infect User's equipment on account of User's access to, use of, or browsing the Website or the downloading of any material, data, text, images, video content, or audio content from the Website. If a User is dissatisfied with the Website, User's sole remedy is to discontinue using the Website.
    4. If THYDOC determines that you have provided fraudulent, inaccurate, or incomplete information, including through feedback, THYDOC reserves the right to immediately suspend your access to the Website or any of your accounts with THYDOC and makes such declaration on the website alongside your name as determined by THYDOC for the protection of its business and in the interests of Users. You shall be liable to indemnify THYDOC for any losses incurred as a result of your misrepresentations or fraudulent feedback that has adversely affected THYDOC or its Users.
  9. BOOK APPOINTMENT AND CALL FACILITYTHYDOC enables Users to connect with Hospital, Doctors and Labs through Book facility that allows Users to book an appointment through the Website.
    1. THYDOC will ensure Users are provided confirmed appointment on the Book facility. However, THYDOC has no liability if such an appointment is later cancelled by the Hospital or Doctors.
    2. The results of any search Users perform on the Website for Hospital, Doctors and Labs should not be construed as an endorsement by THYDOC of any such particular Hospital, Doctors and Labs. If the User decides to engage with a Hospital, Doctors and Labs to seek medical services, the User shall be doing so at his/her own risk.
    3. Without prejudice to the generality of the above, THYDOC is not involved in providing any healthcare or medical advice or diagnosis and hence is not responsible for any interactions between User and the Hospital, Doctors and Labs. User understands and agrees that THYDOC will not be liable for:
      1. User interactions and associated issues User has with the Hospital, Doctors and Labs;
      2. the ability or intent of the Hospital, Doctors and Labs or the lack of it, in fulfilling their obligations towards Users;
      3. any wrong medication or quality of treatment being given by the Hospital, Doctors and Labs, or any medical negligence on part of the Hospital, Doctors and Labs;
      4. inappropriate treatment, or similar difficulties or any type of inconvenience suffered by the User due to a failure on the part of the Hospital, Doctors and Labs to provide agreed Services;
      5. any misconduct or inappropriate behaviour by the Hospital, Doctors and Labs or the Hospital, Doctors and Labs staff;
      6. cancellation or no show by the Hospital, Doctors and Labs or rescheduling of booked appointment or any variation in the fees charged,
      7. Users are allowed to provide feedback about their experiences with the Hospital, Doctors and Labs, however, the User shall ensure that, the same is provided in accordance with applicable law. User however understands that, THYDOC shall not be obliged to act in such manner as may be required to give effect to the content of Users feedback, such as suggestions for delisting of a particular Practitioner from the Website,
      8. In case of a 'Patient-No-Show (P.N.S)' where the User does not show-up at the concerned Hospital, Doctors and Labs.
  10. NOT FOR EMERGENCY USEThe Services are not intended to be a substitute for getting in touch with emergency healthcare. If you are an User facing a medical emergency (either on your or a another person's behalf), please contact an ambulance service or hospital directly.
  11. TERMS FOR USERSNotwithstanding anything contained herein, THYDOC in no manner endorses any Hospitals or Doctors that Users consult and is not in any manner responsible for any drug/medicines prescribed or the therapy prescribed by the Hospitals or Doctors.
  12. TERMS FOR HOSPITALS, DOCTORS AND LABS:
    1. The Hospitals, Doctors and Labs shall promptly reply to the User after receiving User's communication. In case of non-compliance with regard to adhering to the applicable laws/rules/regulations/guidelines by the Hospitals, Doctors and Labs, THYDOC shall have the right to replace such Hospitals, Doctors and Labs or remove such Hospitals, Doctors and Labs from the platform/THYDOC application/site;
    2. The Hospitals, Doctors and Labs understands and agrees that, THYDOC shall at its sole discretion, at any time be entitled to, show as other Hospitals, Doctors and Labs available for booking.
    3. The Hospitals, Doctors and Labs further understand that, there is a responsibility on the Hospitals, Doctors and Labs towards the User.
    4. The Hospitals, Doctors and Labs has the discretion to cancel any booking at any point in time in cases where the Hospitals, Doctors and Labs feels, it is beyond his/her expertise or his/her capacity.
    5. The Hospitals, Doctors and Labs shall at all times ensure that all the applicable laws that govern the Hospitals, Doctors and Labs shall be followed and utmost care shall be taken in terms of the services being rendered.
    6. The Hospitals, Doctors and Labs acknowledges that should THYDOC find the Hospitals, Doctors and Labs to be in violation of any of the applicable laws/ rules/ regulations/ guidelines set out by the authorities then THYDOC shall be entitled to cancel the booking with such Hospitals, Doctors and Labs or take such other legal action as may be required.
    7. It is further understood by the Hospitals, Doctors and Labs that the information that is disclosed by the User at the time of booking an appointment is personal information and is subject to all applicable privacy laws, shall be confidential in nature and subject to User and Hospitals, Doctors and Labs privilege.
  13. CONTENT OWNERSHIP AND COPYRIGHT CONDITIONS OF ACCESS
    1. The contents listed on the Website are (i) User generated content, or (ii) belong to THYDOC. The information that is collected by THYDOC directly or indirectly from the Users and the Hospitals, Doctors and Labs shall belong to THYDOC. Copying of the copyrighted content published by THYDOC on the Website for any commercial purpose or for the purpose of earning profit will be a violation of copyright and THYDOC reserves its rights under applicable law accordingly.
    2. THYDOC authorizes the User to view and access the content available on or from the Website. The contents of the Website, information, text, graphics, images, logos, button icons, software code, design, and the collection, arrangement and assembly of content on the Website (collectively, "THYDOC Content"), are the property of THYDOC and are protected under copyright, trademark and other laws. User shall not modify the THYDOC Content or reproduce, display, publicly perform, distribute, or otherwise use the THYDOC Content in any way for any public or commercial purpose or for personal gain.
    3. User shall not access the Services for purposes of monitoring their availability, performance or functionality, or for any other benchmarking or competitive purposes.
  14. REVIEWS AND FEEDBACK
    1. By using this Website, you agree that any information shared by you with THYDOC or with any Hospital, Doctors and Labs will be subject to our Privacy Policy.
    2. You are solely responsible for the content that you choose to submit for publication on the Website, including any feedback, ratings, or reviews ("Critical Content") relating to Hospital, Doctors and Labs. The role of THYDOC in publishing Critical Content is restricted to that of an 'intermediary' under the Information Technology Act, 2000. THYDOC disclaims all responsibility with respect to the content of Critical Content, and its role with respect to such content is restricted to its obligations as an 'intermediary' under the said Act. THYDOC shall not be liable to pay any consideration to any User for re-publishing any content across any of its platforms.
    3. Your publication of reviews and feedback on the Website is governed by Clause 5 of these Terms. Without prejudice to the detailed terms stated in Clause 5, you hereby agree not to post or publish any content on the Website that (a) infringes any third-party intellectual property or publicity or privacy rights, or (b) violates any applicable law or regulation, including but not limited to the IG Rules and SPI Rules, (c) if the reviews or feedback contains any vulgar, scandalous material. THYDOC, at its sole discretion, may choose not to publish your reviews and feedback, if so required by applicable law, and in accordance with Clause 5 of these Terms. You agree that THYDOC may contact you through telephone, email, SMS, or any other electronic means of communication for the purpose of:
      1. Obtaining feedback in relation to Website or THYDOC services; and/or
      2. Obtaining feedback in relation to any Practitioners listed on the Website; and/or
      3. Resolving any complaints, information, or queries by Practitioners regarding your Critical Content;
  15. RIGHTS AND OBLIGATIONS RELATING TO CONTENT
    1. THYDOC hereby informs Users that they are not permitted to host, display, upload, modify, publish, transmit, update or share any information that:
      1. belongs to another person and to which the User does not have any right to;
      2. is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, pedophilic, libelous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever;
      3. harm minors in any way;
      4. infringes any patent, trademark, copyright or other proprietary rights;
      5. violates any law for the time being in force;
      6. deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;
      7. impersonate another person;

THYDOC, upon obtaining knowledge by itself or been brought to actual knowledge by an affected person in writing or through email signed with electronic signature about any such information as mentioned above, shall be entitled to disable such information that is in contravention of Clauses 12.1 and 12.2. THYDOC shall also be entitled to preserve such information and associated records for at least ……… (………) days for production to governmental authorities for investigation purposes.
    4. In case of non-compliance with any applicable laws, rules or regulations, or the Agreement (including the Privacy Policy) by a User, THYDOC has the right to immediately terminate the access or usage rights of the User to the Website and Services and to remove non-compliant information from the Website.
    5. THYDOC may disclose or transfer User-generated information to its affiliates or governmental authorities in such manner as permitted or required by applicable law, and you hereby consent to such transfer. The SPI Rules only permit THYDOC to transfer sensitive personal data or information including any information, to any other body corporate or a person in India, or located in any other country, that ensures the same level of data protection that is adhered to by THYDOC as provided for under the SPI Rules, only if such transfer is necessary for the performance of the lawful contract between Dr THYDOC spanel or any person on its behalf and the User or where the User has consented to data transfer.
    6. THYDOC respects the intellectual property rights of others and we do not hold any responsibility for any violations of any intellectual property rights
  16. TERMINATION
    1. THYDOC reserves the right to suspend or terminate a User's access to the Website and the Services with or without notice and to exercise any other remedy available under law, in cases where,
    2. Such User breaches any terms and conditions of the Agreement;
    3. A third party reports violation of any of its right as a result of your use of the Services;
    4. THYDOC is unable to verify or authenticate any information provide to THYDOC by a User;
    5. THYDOC has reasonable grounds for suspecting any illegal, fraudulent or abusive activity on part of such User; or
    6. THYDOC believes in its sole discretion that User's actions may cause legal liability for such User, other Users or for THYDOC or are contrary to the interests of the Website.
    7. Once temporarily suspended, indefinitely suspended or terminated, the User may not continue to use the Website under the same account, a different account or re-register under a new account. On termination of an account due to the reasons mentioned herein, such User shall no longer have access to data, messages, files and other material kept on the Website by such User. The User shall ensure that he/she/it has continuous backup of any medical services the User has rendered in order to comply with the User's record keeping process and practices.
  17. RETENTION AND REMOVALTHYDOC may retain such information collected from Users from its Website or Services for as long as necessary, depending on the type of information; purpose, means and modes of usage of such information; and according to the SPI Rules. Computer web server logs may be preserved as long as administratively necessary.
  18. APPLICABLE LAW AND DISPUTE SETTLEMENT
    1. You agree that this Agreement and any contractual obligation between THYDOC and Hospital, Doctors and Labs and Users will be governed by the laws of India.
    2. Any dispute, claim or controversy arising out of or relating to this Agreement, including the determination of the scope or applicability of this Agreement to arbitrate, or your use of the Website or the Services or information to which it gives access, shall be determined by arbitration in India, before a sole arbitrator appointed by THYDOC. Arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996. The seat of such arbitration shall be Jaipur, Rajasthan. All proceedings of such arbitration, including, without limitation, any awards, shall be in the English language. The award shall be final and binding on the parties to the dispute.
    3. Subject to the above Clause 9.2, the courts at Jaipur, Rajasthan shall have exclusive jurisdiction over any disputes arising out of or in relation to this Agreement, your use of the Website or the Services or the information to which it gives access.

In the event you suffer as a result of access or usage of our Website by any person in violation of Rule 3 of the IG Rules, please address your grievance to the above person.
  20. SEVERABILITY If any provision of the Agreement is held by a court of competent jurisdiction or arbitral tribunal to be unenforceable under applicable law, then such provision shall be excluded from this Agreement and the remainder of the Agreement shall be interpreted as if such provision were so excluded and shall be enforceable in accordance with its terms; provided however that, in such event, the Agreement shall be interpreted so as to give effect, to the greatest extent consistent with and permitted by applicable law, to the meaning and intention of the excluded provision as determined by such court of competent jurisdiction or arbitral tribunal.
  21. WAIVER No provision of this Agreement shall be deemed to be waived and no breach excused, unless such waiver or consent shall be in writing and signed by THYDOC. Any consent by THYDOC to, or a waiver by THYDOC of any breach by you, whether expressed or implied, shall not constitute consent to, waiver of, or excuse for any other different or subsequent breach.
